Date set for Anderson murder trial
Danny Ray Anderson, of Lenoir, has been charged with first-degree murder and possession of a firearm by a felon. He is accused of shooting Vivian C. Kincaid on May 24, 2008. Reports show that officers with the Lenoir Police Department responded to a domestic dispute at 118 Carolina Drive with reports that someone had been shot in the head. A caller advised that the man who lived in the house had shot a lady in the head while outside, and he was trying to get in the house. The caller said the man was drunk and begged for police to arrive quickly. The gun possession charge was added on June 2, 2008 when officers searched his residence.
Anderson, who remains in custody, pleaded not guilty Thursday. His trial has been scheduled for Monday, July 26, and prosecutors have indicated that he will be the first name on the docket. Both the murder and possession charges will be joined for trial.
Meanwhile, Victoria Jayne, defense attorney for Herbert Peck, requested copies of the transcripts from all proceedings to date. Beal granted this request, but he said that copies also needed to be delivered to the District Attorney’s office. Jayne also indicated that she plans on submitting a bond request for Peck during the May 3 administrative session.
Peck, 68, currently is being held without bond. He was charged with first-degree murder in the Nov. 14, 2009, death of his wife, Glenda Dian Peck, at the couple’s residence, located at 3190 Covington Way, Lenoir.
Officers with the Caldwell County Sheriff’s Office, Caldwell County Emergency Medical Services and North Catawba Fire and Rescue were dispatched to the couple’s home shortly before 4:15 a.m. that November morning after Glenda called and said her husband was having a medical problem and had become violent.
When they arrived on scene, officers made forcible entry into the locked home and found Glenda lying on the living room floor, the victim of multiple gunshot wounds. Reports show that Peck was hiding in the bathroom closet and taken into custody without incident.
As for the cases of Edward Carlton Anderson, Barney Dunlap and Chad Pearson, they have been continued until the May 3 administrative session.
Anderson was arrested Dec. 22, 2009, and charged with first-degree murder. He was indicted on that same charge by a Caldwell County grand jury Jan. 11. Anderson is accused of shooting Larry Eugene Kidd, 51, of 2774 Twin Meadow Drive, Hudson.
According to court documents, LPD received an incomplete 911 call from a Guildwood Place home shortly before noon. Cpl. Mark Barlowe was the first to respond to the scene, and he found Anderson at the door. Barlowe said he took Anderson into custody and waited for backup after Anderson reportedly said, “I shot a guy.”
As LPD officers and members of the State Bureau of Investigation entered the home, court records show they found Kidd slumped over in a couch, the victim of a gunshot wound to the chest area.
Dunlap is accused of shooting Gerald Keith Lakey and Roslyn Dunlap on May 9, 2008. Reports show that LPD patrolman Gary Dishman was in a parking lot at 2:30 a.m. when Dunlap pulled up in a white van and approached him. Dishman took Dunlap into custody after he told Dishman that he “killed his wife and her boyfriend.”
When officers arrived at the Queens Street home, they found Lakey unresponsive in the bedroom and Roslyn Dunlap alive in the living room. She had suffered a gunshot to her upper abdominal area. Dunlap was rushed to Caldwell Memorial Hospital, and she died the following morning at Wake Forest Baptist Medical Center.
Pearson has been charged with first-degree murder in the death of Irene Pearson on Jan. 1, 2008. According to documents, a 911 emergency call came in at 1:42 a.m. about a shooting at 3261 Friendly Park Road, Lenoir. When officers arrived, they found Irene Pearson deceased, the victim of a gunshot wound. Chad Pearson was a detention officer with the Caldwell County Sheriff’s Office at the time.
